1. What BrandChef Does

BrandChef is an artificial-intelligence-powered marketing platform that helps businesses develop marketing strategy, campaigns, messaging, copy, images, video, audio, marketing calendars, and other marketing materials.To provide the Service, BrandChef may analyze information you provide and information from websites, social-media accounts, connected services, and other digital sources you identify, connect, or authorize BrandChef to analyze. The information we process depends on how you use the Service.

3. Information We Analyze From Websites and Social Media

At your direction, BrandChef may retrieve and analyze information available from a website, social-media account, or other digital source. This can include website text, images, product and service descriptions, pricing, promotions, social-media posts and captions, brand language, visual style, business information, and other publicly available content.BrandChef may analyze multiple sources—for example, a business website and its social-media presence—to develop a more complete and current understanding of the business. We use this information for functions such as brand analysis, market analysis, strategy development, competitive analysis, and campaign generation.BrandChef does not control information published by third-party websites or platforms and cannot guarantee that such information is accurate or current.

4. Sources of Personal Information

6. How BrandChef Uses Artificial Intelligence

BrandChef uses artificial-intelligence technologies to analyze information and generate marketing strategies, recommendations, and creative content. Information submitted to BrandChef may therefore be processed by AI technology providers acting on our behalf.Depending on the feature used, this may include business and brand information, website and social-media content, User Content, instructions, campaign information, and other information necessary to generate the requested output.Google Gemini and Related AI ServicesBrandChef currently uses artificial-intelligence technologies provided by Google, including Gemini and related Google AI services. Information necessary to generate AI-powered results may be transmitted to Google's systems for processing.Where our applicable paid Google AI service terms provide that customer prompts and responses are not used to improve or train Google's general-purpose models, BrandChef does not authorize such use. Certain Google services or features may retain information for security, abuse monitoring, or service-specific purposes.BrandChef will not intentionally opt customer prompts, generated content, or customer datasets into voluntary third-party AI model-training or data-sharing programs without appropriate authorization.

7. AI Training and Product Improvement

BrandChef does not sell your business information or User Content to AI companies for model training.BrandChef may use information about how the Service performs to maintain, evaluate, and improve BrandChef—for example, to identify errors, improve workflows, measure feature usefulness, and improve system performance.Where customer content is used for internal product improvement beyond simply providing the Service, we will do so consistent with this Privacy Policy, applicable law, and contractual obligations.BrandChef will not intentionally contribute confidential customer content to third-party general-purpose AI training datasets without appropriate authorization.

8. Connected Accounts and Third-Party Platforms

BrandChef may allow you to connect third-party accounts or services. When you choose to connect a service, BrandChef may receive information that you authorize that service to provide. The information available depends on the service, your account settings, and the permissions you grant.BrandChef uses information obtained through connected services to provide the functionality you request and for the purposes described in this Privacy Policy. You may be able to revoke BrandChef's access through BrandChef or the applicable third-party service.Third-party platforms have their own privacy policies and practices, which BrandChef does not control.

9. Google Cloud and FirebaseBrand

Chef uses Google Cloud and Firebase infrastructure for portions of the Service, which may include authentication, databases, file storage, application hosting, computing infrastructure, and related platform services.Information may therefore be stored and processed using Google infrastructure in the United States or other locations in which the applicable services operate.

10. Payment Information

BrandChef may use Stripe or another payment processor to process subscription payments. When you purchase a subscription, payment information is provided directly to the payment processor. BrandChef generally does not receive or store your complete credit-card number.We may receive information necessary to manage your subscription, such as your name, billing contact information, payment status, subscription level, transaction amount, payment-method type, transaction identifiers, and limited payment details such as the last four digits of a card.

11. Cookies and Similar Technologies

BrandChef may use cookies, local storage, and similar technologies to keep users signed in, remember preferences, maintain sessions, secure accounts, understand usage, diagnose technical issues, and improve the Service. Some technologies are necessary for BrandChef to function. Other analytics or advertising technologies, if used, may be subject to consent or opt-out requirements.Some browsers provide privacy signals such as Global Privacy Control (GPC) or Do Not Track. These mechanisms are not necessarily the same. Where BrandChef is legally required to recognize a qualifying universal opt-out mechanism such as GPC, we will do so. BrandChef may not respond to traditional Do Not Track signals unless required by applicable law.

12. Analytics

BrandChef may use analytics tools to understand how visitors and customers interact with the Service. Analytics information may include pages visited, features used, session duration, device information, general geographic information, and interactions with the Service.Before publication, BrandChef will identify material analytics or advertising technologies in use where disclosure is required.

13. How We Share Information

BrandChef does not sell your personal information in exchange for money.We may disclose information to service providers that help operate BrandChef, including providers of cloud hosting, artificial intelligence, authentication, databases and storage, payment processing, analytics, security, customer support, communications, and other infrastructure.We may also disclose information at your direction or with your consent; when reasonably necessary to comply with law or legal process, protect rights, property, safety, or security; or in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, subject to applicable law.

14. Sale, Sharing, and Targeted Advertising

BrandChef does not currently sell personal information for monetary consideration.Some privacy laws define sale, sharing, or targeted advertising more broadly than an exchange for money. If BrandChef uses advertising technologies or engages in activities legally considered a sale of personal data, sharing for cross-context behavioral advertising, or targeted advertising, we will provide the disclosures and opt-out mechanisms required by applicable law.Before publication, BrandChef should confirm whether technologies such as Meta Pixel, Google Ads remarketing, LinkedIn Insight Tag, or similar advertising tools are installed.

15. Sensitive Personal Information

BrandChef is not designed for the submission of highly sensitive personal information unless a feature expressly requests it. Please do not unnecessarily provide Social Security numbers, government identification numbers, complete financial-account credentials, medical records, genetic information, biometric identifiers, third-party passwords, or other highly sensitive personal information.Where BrandChef processes legally defined sensitive data, we will obtain consent where required.

16. Aggregated and De-identified Information

BrandChef may create aggregated or de-identified information from information processed through the Service. We may use it to understand feature usage, campaign-development workflows, system performance, general business categories, technical errors, and overall usage trends.We may use aggregated or de-identified information to operate, analyze, improve, and develop BrandChef, provided that the information does not reasonably identify you or your business as an individual customer. Where required by law, BrandChef will maintain de-identified information in de-identified form and will not attempt to re-identify it.

17. Data Retention

BrandChef retains personal information only for as long as reasonably necessary for the purposes for which it was collected or as otherwise permitted or required by law.Retention depends on factors including the nature of the information; whether you maintain an active account; whether information is necessary to provide features you use; contractual requirements; security and fraud-prevention requirements; legal and regulatory obligations; dispute-resolution requirements; and applicable limitation periods.When information is no longer reasonably necessary, BrandChef may delete, anonymize, or de-identify it. Information may remain temporarily in backups and disaster-recovery systems after deletion from active systems. Third-party service providers may retain information according to their contractual obligations and applicable legal requirements.

18. Data Security

BrandChef uses reasonable administrative, technical, and organizational measures designed to protect information against unauthorized access, destruction, loss, alteration, or disclosure. These measures may include access controls, authentication, encryption, and security controls provided by our infrastructure providers.No internet transmission, cloud service, or electronic-storage system can be guaranteed to be completely secure. You are responsible for maintaining the confidentiality of your account credentials.

19. U.S. State Privacy Rights

Depending on where you reside and whether applicable privacy law applies to BrandChef, you may have rights to confirm processing; access information; obtain a portable copy of certain information; correct inaccurate information; request deletion; opt out of certain sales, sharing, targeted advertising, profiling, or automated decision-making; limit certain uses of sensitive information; withdraw consent where applicable; and appeal certain privacy-request decisions.BrandChef will not discriminate against you for exercising rights provided by applicable law.To submit a privacy request, contact legal@brandchef.ai. We may take reasonable steps to verify your identity before processing certain requests.

20. Connecticut Residents

Where the Connecticut Data Privacy Act applies, Connecticut residents may have rights including access, correction, deletion, data portability, and opt-out rights concerning certain sales of personal data, targeted advertising, and qualifying profiling.Where applicable, you may also appeal BrandChef's decision concerning a privacy request by emailing legal@brandchef.ai with 'Privacy Appeal' in the subject line.

21. California Residents

California law may provide California residents with additional privacy rights when applicable to BrandChef. These can include rights to know categories and specific pieces of personal information collected, categories of sources, purposes for collection and use, categories of third parties receiving information, deletion, correction, and opting out of certain sales or sharing.BrandChef does not sell personal information for monetary consideration. If BrandChef becomes subject to additional requirements under California law, this Privacy Policy and BrandChef's privacy controls will be updated accordingly.

22. Authorized Agents

Where applicable law permits, you may designate an authorized agent to submit a privacy request on your behalf. BrandChef may require evidence that you authorized the agent to act for you and may separately verify your identity before fulfilling the request.

23. Children

BrandChef is intended for businesses and adults and is not directed to children. You must be at least 18 years old to create a BrandChef account unless otherwise expressly permitted by BrandChef and applicable law.We do not knowingly collect personal information directly from children through BrandChef accounts. If you believe a child has improperly provided personal information, contact legal@brandchef.ai.

24. Marketing Communications

BrandChef may send account-related communications necessary to provide the Service and may send promotional communications where permitted by law. You may unsubscribe from promotional email using the mechanism in those messages. Unsubscribing from marketing does not prevent transactional or service-related communications.

25. International Users

BrandChef is operated from the United States. If you access BrandChef from outside the United States, your information may be transferred to and processed in the United States and other countries where BrandChef's service providers operate. Where required by applicable law, BrandChef will use appropriate mechanisms for international transfers.

26. Changes to This Privacy Policy

We may update this Privacy Policy as BrandChef evolves, our technology changes, or applicable privacy laws change. When we make material changes, we will update the Last Updated date and provide additional notice when required by law. If a change materially alters how previously collected personal information is used, we will obtain consent where required.
